Home | Finance | Personal Finance Many people including myself have had or do have these problems. Most people think they must hire an attorney to deal with them, however that is not always the case. I'm not saying an attorney isn't necessary, but if you don't need one why pay for one? I have been told that insurance companies don't like to pay out. This is true to some extent, but they usually don't have a problem with it because they can usually just raise there premium a little to cover it. Insurance agents aren't paid to ignore you delay your claim etc. They are paid to document accidents. It is true however that insurance companies don't like going to court, but they must defend their client if he or she is being sued. Lets face it, it cost money to pay attorneys cost of court and such. If your claim isn't very large most insurance companies would rather pay your claim than go to court. You just need to give them something to document. Such as a letter containing the following information:
If you know they have already paid someone else who was involved in the accident. Remind them of that, and ask why your claim hasn't been paid. Include a copy of the accident report, copies of your bills, and a statement from your employer stating what time you have missed from work due to the accident. Let them know that if they don't respond to the letter that you will take them and there client to claims court. Make a copy of the letter, and send it certified mail. Keep that copy so if you do have to go to claims court you will have something to show the judge. Most judges are normal everyday hard working people just like you and me most times if you show them a copy of this letter you will win. The insurance company knows this. I am not a lawyer, however I did speak with one and this is the advice he gave me. He told me that it usually wasn't worth paying 18 to 20% of my claim to a personal injury attorney if my claim was small, and that they would preferably just write the same letter.
