Do Online Gamblers Play by the Rules?

By: Bud Sayce

Sports betting or gambling has become more and more popular over the years. Its popularity has been further intensified by the growth of online sports betting, also known as Internet gambling. However, online sports betting has long been the subject of many controversies. And, one controversy in particular is its legality.

When it comes to online sports betting, it is quite common for people to wonder whether they're breaking any local or state laws. You may be aware that sport betting has been deemed illegal in many countries around the world. One particular region that strongly upholds anti-sport betting law is North America. Most American states and even the federal government have passed legislations concerning online and offline gambling.

Until recently, the act of regulating online sport betting was left entirely to the discretion of the individual North American provincial and state governments. The advent of online sport betting has, to some degree, created certain levels of confusion about the jurisdiction. One main question that continues to crop up is, "Who is in charge of the laws in the virtual world?" As you probably know, many current gambling laws were created and enacted before the Internet was even invented. That's what makes the applications of established laws open to different interpretations.

Aside from concerns about the online sport betting laws, concerned individuals also asks whether it is legal to run sport betting online or offshore, and take business away from clients in the United States. It's commonly understood that the U.S. government deems foreign or online sport betting to be illegal.

So it is assumed that online sports betting are considered illegal by the U.S. government. However, numerous reports have revealed that no bills have been passed to prevent the custom of online sports betting. Much worse is that, several attempts to pass bills in order to thwart the enduring popularity of online sports betting dramatically failed.

One particular reason that caused the failure of those anti-sport gambling bills is that the federal government placed much of the jurisdiction for gambling into the hands of individual states. Some of those states have approved the practice of online sport gambling and several states, including North Dakota, actually held a legalization vote.

On the other hand, Illinois and some other states have added certain legislations that strictly prohibit the promotion of online casinos within the state. Thus far, only Nevada, California, and Louisiana have strongly prohibited residents from gambling beyond the state borders.

Now, since some states have enforced (albeit loosely) anti-gambling laws, several online sport books have opted to stay offshore in foreign countries. To avoid breaching the laws, they set up their computer servers offshore as well.

Further, while anti-gambling laws have been passed, no citizen has been arrested for participating in online sport betting. Things are quickly changing in this industry and in the legal arena, so keep your eyes on the law... and on the game!
